Introduction

  • Welcome to Lyvo, a digital platform operated by MASHED DESIGNS SL, a company registered in Mallorca, Spain. These Terms and Conditions ("Terms") govern your use of the Lyvo platform, available at [www.lyvo.com] and related mobile applications, which serve as a marketplace connecting luxury homeowners and tenants with verified local service professionals ("Experts") in Mallorca.
  • By accessing or using Lyvo, you agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific services or features. If you do not agree with any of these provisions, you must not use the Platform.


Definitions

  • Platform: The Lyvo website and/or mobile application.
  • Lyvo: The entity operating the platform, facilitating the connection between Clients and Experts.
  • Client: Any individual or legal entity using Lyvo to search for or book services.
  • Expert: A vetted service provider offering goods or services through the Platform.
  • Services: Tasks, consultations, maintenance, hospitality, or any other offerings listed on Lyvo.
  • User: Any person using the Platform, whether registered or not.
  • Booking: A confirmed request for services facilitated through Lyvo.
  • Terms: This legally binding agreement between Users and Lyvo.


Scope of the Platform

  • Lyvo acts solely as an intermediary to facilitate connections between Clients and Experts. We do not provide, perform, or assume responsibility for any services offered by Experts.
  • Users understand and accept that any service contract is strictly between the Client and the Expert.
  • Lyvo does not endorse any particular Expert, and all services are rendered at the Client’s sole discretion and risk.


Eligibility and Account Creation

  • To use Lyvo, Users must be at least 18 years old and legally able to enter into contracts.
  • Account registration requires providing accurate, complete, and updated information. Users are responsible for maintaining the confidentiality of their credentials.
  • Users agree not to impersonate another individual, provide false information, or create multiple accounts without consent from Lyvo.


Verification of Experts

  • Experts undergo a rigorous screening process that may include:
  • Identity verification using official documents
  • Review of professional licenses, insurance, or permits
  • Evaluation of previous customer reviews and testimonials
  • Ongoing performance monitoring by Lyvo's internal quality control team
  • Lyvo reserves the right to remove Experts that do not meet quality, safety, or compliance expectations.


User Responsibilities

  • Clients agree to provide safe and lawful environments for services to be rendered.
  • Experts agree to conduct all activities professionally and lawfully, with appropriate tools, attire, and conduct.
  • Users agree not to circumvent the Platform by engaging with each other outside Lyvo for the same or similar services, which will result in account suspension.


Fees, Pricing, and Payment

  • Experts determine their own pricing. Lyvo may charge service or platform fees to Clients and/or Experts.
  • Payments are processed securely via third-party payment gateways. Lyvo is not liable for payment processing errors or failures.
  • Lyvo may temporarily hold payments to Experts until service completion is confirmed by the Client.


Booking Process

  • Bookings must be made through the Lyvo platform and are not confirmed until payment is authorized or accepted.
  • Each Booking will include a scope of service, estimated duration, pricing, cancellation policy, and contact details.
  • Clients may request modifications prior to service execution, subject to Expert approval.


Cancellations and Refunds

  • Cancellations initiated by the Client may be subject to fees depending on timing and Expert policy.
  • Experts may cancel due to unforeseen circumstances; Lyvo will endeavor to reassign another qualified Expert.
  • All refund requests are handled case-by-case and may require supporting documentation or investigation.


Reviews, Disputes and Ratings

  • Clients may submit ratings and reviews of Experts. These must be truthful and not defamatory.
  • Experts may publicly respond to reviews to clarify or contest feedback.
  • Disputes should first be addressed through Lyvo’s resolution process before legal escalation.


Code of Conducte

  • Users must interact respectfully and professionally. The following are prohibited:
  • Harassment or discrimination of any kind
  • Use of fraudulent identities or documentation
  • Interference with another user’s ability to use the Platform
  • Any criminal activity or solicitation thereof


Intellectual Property

  • All Platform content, branding, software, and design are owned by Lyvo or licensed to it and protected under intellectual property laws.
  • Users grant Lyvo a royalty-free, worldwide, non-exclusive license to use uploaded content for promotional and operational purposes.


Privacy and Data Security

  • Lyvo follows the highest standards of data protection, including encryption and GDPR compliance.
  • Users may access, rectify, or delete their personal data by contacting privacy@lyvo.com.
  • We do not sell or share your data with third parties except for operational necessity or legal compliance.


Platform Availability and Updates

  • Lyvo does not guarantee uninterrupted access to the Platform.
  • Scheduled maintenance or emergency updates may affect availability temporarily.
  • We may add, remove, or alter features without prior notice.

 

Limitation of Liability

  • Lyvo is not liable for service performance, property damage, or injuries arising from interactions between Clients and Experts.
  • In no event will Lyvo’s liability exceed the amount paid by the Client in the 30 days prior to the claim event.
  • Users waive claims against Lyvo for consequential, incidental, or indirect damages. 


Termination and Suspension

  • Lyvo may suspend or terminate access for violations of these Terms or applicable laws.
  • Termination may occur without notice in cases of fraud, abuse, or threats to the platform or other users.
  • Users may deactivate their account at any time; however, service records may be retained for legal or operational reasons.


Governing Law and Jurisdiction

  • These Terms are governed by the laws of Spain and the autonomous region of the Balearic Islands.
  • All disputes shall be submitted to the courts of Palma de Mallorca, unless otherwise required by mandatory consumer law.
 

Non-Circumvention & Off-Platform Activity

 To protect the integrity of the Lyvo platform and its network of users:

  • Users agree not to solicit, accept, or offer services or compensation outside of the Lyvo platform if the initial introduction was made through Lyvo.
  • This restriction applies during the term of your account and for a period of 24 months following the most recent Booking between the same Client and Expert.
  • Circumventing the Platform by directly engaging or re-engaging for services — including but not limited to repeat tasks, ongoing contracts, or referrals — without using Lyvo’s Booking process is strictly prohibited.

Violations may result in:

  • Immediate suspension or termination of the User's account,
  • Forfeiture of any pending payments,
  • Liquidated damages equal to €5,000 or the value of the off-platform services rendered (whichever is greater),
  • Legal action where necessary to protect the platform and its users.

Lyvo reserves the right to monitor, investigate, and audit user interactions to detect and prevent circumvention.

If a Client or Expert wishes to form a direct contractual relationship independent of Lyvo, both parties must request written approval and may be subject to a conversion fee.


Changes to Terms

  • Lyvo may revise these Terms periodically. Users will be notified via email or platform notice.
  • Continued use of Lyvo after updates constitutes acceptance of the new Terms.
